Terms and Conditions

By accessing this webpage, you are agreeing to be bound by these Terms and Conditions (“Terms") in a legally binding agreement between us (“Merchant”or“us” or “we”or“our” ) and the User (“you” or “your”). Please read these Terms carefully before accessing or using the Platform. If you do not agree to the Terms, you may not access the Platform. We reserve the right to update and change the Terms and Conditions by posting updates and changes to the Platform. You are advised to check the Terms and Conditions from time to time for any updates or changes that may impact you. If at any point such amendments are not acceptable to you, we advise you to cease using the Platform at such time.

1. ELIGIBILITY

You hereby represent and warrant that you have the right, power, and authority to agree to the Terms, to become a party to a legally binding agreement and to perform your obligations here under.

2. DEFINITIONS

  • “Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS) or any other methods of payments which shall be developed or added or deployed by banks and financial institutions from time to time.
  • “Platform” refers to the website or platform where the Merchant offers its products or services and where the Transaction may be initiated.
  • “Transaction” shall refer to the order or request placed by the User with the Merchant to purchase the products and/or services listed on the Platform by paying the Transaction Amount to the Merchant;
  • “Transaction Amount” shall mean the amount paid by the User in connection with a Transaction; and
  • “User/Users”, means any person availing the products and/or services offered on the Platform;
  • “Website” shall mean www.instamojo.com or the mobile application

3. MERCHANT'S RIGHTS

You agree that we may collect, store, and share the information provided by you in order to deliver the products and/or services availed by you on our Platform and/or contact you in relation to the same.

4. YOUR RESPONSIBILITIES

  • You shall be solely responsible for all activities undertaken through your account on the Platform.
  • You shall comply with all applicable laws and regulations in your use of the Platform.

5. PROHIBITED ACTIONS

  • You shall not use the Platform for any illegal or unauthorized purpose.
  • You shall not interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
  • You shall not attempt to gain unauthorized access to the Platform or its related systems or networks.
  • You shall not use the Platform to transmit any harmful, infringing, or unlawful content.
  • You shall not use the Platform to send unsolicited commercial communications.
  • You shall not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • You shall not collect or store personal data about other users without their express consent.
  • You shall not engage in any activity that would constitute a criminal offense or give rise to civil liability.
  • You shall not use the Platform to upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • You shall not use the Platform to upload, post, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • You shall not use the Platform to upload, post, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • You shall not use the Platform to upload, post, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • You shall not use the Platform to interfere with or disrupt the Platform or servers or networks connected to the Platform, or disobey any requirements, procedures, policies, or regulations of networks connected to the Platform.
  • You shall not use the Platform to intentionally or unintentionally violate any applicable local, state, national, or international law.
  • You shall not use the Platform to "stalk" or otherwise harass another.
  • You shall not use the Platform to collect or store personal data about other users.
  • You shall not use the Platform to promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.
  • You shall not use the Platform to engage in commercial activities without our prior written consent.
  • You shall not use the Platform to resell or make any commercial use of the Platform.
  • You shall not use the Platform to make any derivative use of the Platform.
  • You shall not use the Platform to download or copy account information for the benefit of another merchant.
  • You shall not use the Platform for data mining, robots, or similar data gathering and extraction tools.
  • You shall not use the Platform to frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Platform without our express written consent.
  • You shall not use the Platform to use any meta tags or any other "hidden text" utilizing our name or trademarks without our express written consent.
  • You shall not use the Platform to reverse engineer, decompile, or disassemble any portion of the Platform.
  • You shall not use the Platform to modify, adapt, translate, or create derivative works based on the Platform.
  • You shall not use the Platform to remove any copyright, trademark, or other proprietary rights notices contained in or on the Platform.
  • You shall not use the Platform to circumvent any technological measure implemented by us or any of our providers or any other third party (including another user) to protect the Platform.
  • You shall not use the Platform to forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Platform to send altered, deceptive, or false source-identifying information.
  • You shall not use the Platform to attempt to probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures.
  • You shall not use the Platform to avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by us or any of our providers or any other third party (including another user) to protect the Platform.

6. LIMITATION OF LIABILITY

In no event shall we be liable for any damages whatsoever, including, but not limited to, any direct, indirect, special, incidental, consequential, or exemplary damages, arising out of or in connection with the use or inability to use the Platform or the information, content, materials, products (including software) or services included on or otherwise made available to you through the Platform, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

7. GOVERNING LAWS & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

9. DISCLAIMER

The Platform and all information, content, materials, products (including software) and services included on or otherwise made available to you through the Platform are provided by us on an "as is" and "as available" basis, unless otherwise specified in writing. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, materials, products (including software) or services included on or otherwise made available to you through the Platform, unless otherwise specified in writing. You expressly agree that your use of the Platform is at your sole risk.

To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Platform; information, content, materials, products (including software) or services included on or otherwise made available to you through the Platform; our servers; or electronic communications sent from us are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the Platform or from any information, content, materials, products (including software) or services included on or otherwise made available to you through the Platform, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
